Luxembourg Law of Security Interests over Movable Assets

Book | 1st edition 2023 | Luxembourg | Hannes Westendorf
Description

Security interests are crucial for economic development and they are particularly important in the context of the Luxembourg financial centre. Even though there is Luxembourg legal writing on some aspects of the law of security interests over movable assets, there has - until now - not been an in-depth analysis taking into account all recent legal developments and in particular case law. This book also refers to Belgian and French law insofar as they are relevant for a complete analysis of Luxembourg law.

The book is divided into two parts.

The first part treats all different kinds of pledges consisting of, amongst others, the civil and commercial law pledges, as well as the pledge as financial collateral arrangement and the pledge over a business.

The second part examines all kinds of payment guarantees conferring an exclusive right upon the creditor, which include the right of retention and title-based security such as retention of title techniques as well as title transfer for security purposes.
