Ce livre est la suite du célèbre rapport Edward sur le secret professionnel de l’avocat en Europe de 1976, mis à jour en 2003. La conception civiliste du secret professionnel est exposée par M. Paul Martens, président de la Cour constitutionnelle belge, et la notion du legal privilege, par M. Richard Plender, juge à la High Court de Londres. La jurisprudence des cours de Strasbourg et Luxembourg fait l’objet des rapports de MM. Dean Spielmann et Nicholas Forwood, respectivement juges à la Cour européenne des droits de l’homme et au Tribunal de l’Union européenne. Enfin, vingt rapports nationaux font le point sur les implications du secret en matière pénale, fiscale et en droit de la concurrence.

This book is the sequel of the famous Edward report on professional secrecy, confidentiality and legal professional privilege in Europe in 1976, updated in 2003. The civil law concept of the secret professionnel is explained by Mr. Paul Martens, President of the Belgian Constitutional Court, and the concept of legal privilege by Mr. Richard Plender, Judge at the High Court in London. Reports on the case law of the Strasbourg and Luxembourg Courts were drafted by Mr Dean Spielmann and Mr. Nicholas Forwood, judges at the European Court of Human Rights and the General Court of the European Union respectively. Finally, twenty national reports review the implications of legal privilege in criminal, tax and competition law.
