Questions relating to the reception of asylum seekers in the EU are of growing importance. However, the rights of asylum seekers and the obligations of European States towards them appear to vary according to the applicable legal regime, given, in particular, the different approaches taken by the European Court of Justice in Luxembourg and the European Court of Human Rights in Strasbourg.
This book examines the situations of people fleeing armed conflict under the Geneva Refugee Convention, the European Convention on Human Rights and EU law (in particular the Qualification Directive). It analyses these different regimes and their interactions, looking not only at matters of substantive law, but also at questions of evidence and procedure. The book consequently has not only a theoretical impact a very practical interest to all persons interested in human rights and refugee law.

Les questions relatives à l’accueil des demandeurs d’asile dans l’UE sont d’une importance croissante. Cependant, les droits des demandeurs d’asile et les obligations des États européens envers eux semblent varier selon le régime juridique applicable, en particulier à cause des différentes approches adoptées par la Cour européenne de justice de Luxembourg et la Cour européenne des droits de l’homme Strasbourg. Cet ouvrage examine les situations de personnes fuyant les conflits armés sous la Convention de Genève relatif au statut des refugiées, la Convention européenne des droits de l’homme et du droit de l’UE (en particulier la directive qualification). Il analyse ces différents régimes et leurs interactions, s’intéresse non seulement à des questions de fond, mais aussi de preuve et de procédure.
L'ouvrage est par conséquent d'un intérêt académique et pratique à toutes personnes intéressées par le droit d’asile et par les droits de l’homme.
